In view of the TUBOTEC brand name fraudulent use and the deceitful and false statements spread at the TUBOTEC website (www.tubotec.com) by José Manuel Valero Salinas (José M. Valero, S.L.- Grupo Valero), FATECSA affirms:
- To whom it might concern, FATECSA informs, that since 1984 FATECSA manufactures building tubes. From 1988 to 2003, these tubes were made and sell under TUBOTEC brand name.
- TUBOTEC brand was created in order to highlight the tubes quality made by FATECSA, so just on these tubes this brand is permitted to appear.
- Mr. Valero is not entitled to use the referred brand neither by FATECSA nor by any judicial decision.
- Mr. Valero is not legally allowed to use on any product, TUBOTEC brand name but those made by FATECSA.
According with the above mentioned considerations, FATECSA states:
- 1º Mr. Valero's website statements are completely false.
- 2º Mr. Valero is not allowed to use TUBOTEC brand name.
- 3º FATECSA do not guarantee, neither the quality nor the performance of the "VALERO" or "TUBOTEC" brand stamped tubes. Both brand stamped tubes, are identical but with a different brand name stamped. According with the tubes quality performance, we appreciate the technology used to made these tubes is different to the one used by FATECSA.
- 4º FATECSA reserves the right to take any legal actions against José Manuel Valero Salinas (José M. Valero, S.L.- Grupo Valero) and any third party for perpetration of illegal use of FATECSA brand name. Note: The above Mr. Valero mentioned verdict, is not definitive yet as the case was referred to the Court of Appeal.
